ServerSecretVault End User License Agreement

This End User License Agreement (the "Agreement") is between you, the
individual or the organization on whose behalf you act, and ServerSecretVault
("we", "us"). It covers the ServerSecretVault software, including the ssv
program, its installers and its documentation (the "Software").

By downloading, installing or using the Software you accept this Agreement. If
you do not accept it, do not download, install or use the Software.

1. License

Subject to this Agreement, we grant you a non-exclusive, non-transferable,
non-sublicensable license to install and use the Software on servers that you
own or administer, for your own purposes or to administer servers for your
clients.

2. Ownership

The Software is licensed, not sold. We and our licensors keep all rights, title
and interest in the Software, including all intellectual property rights. All
rights not expressly granted in this Agreement are reserved.

3. Restrictions

Except as this Agreement allows, or as applicable law allows in a way that
cannot be excluded by contract, you must not:

  (a) copy the Software, except as needed to install and use it as allowed
      above and to keep reasonable backup copies;
  (b) sell, rent, lease, lend, sublicense, distribute, publish or otherwise
      make the Software available to anyone else, including through a download
      site, mirror, package repository or container image;
  (c) modify, translate or create derivative works of the Software;
  (d) reverse engineer, decompile or disassemble the Software, or otherwise
      attempt to obtain its source code;
  (e) remove or alter any copyright, license or other notice in the Software;
      or
  (f) use the Software to access systems or data that you are not authorized
      to access.

4. Third-party software

The Software contains third-party components that are licensed under their own
terms, which are set out in the THIRD_PARTY_NOTICES file and shown by the
command "ssv license". Nothing in this Agreement limits your rights under those
terms.

The age encryption tool used by "ssv backup" is a separate program, not part of
the Software, and is licensed by its authors under its own terms.

5. Your systems and data

The Software runs entirely on your systems. It does not send your files,
secrets or usage information to us or to anyone else. You are responsible for
your servers, your data, your backups, and the keys and passphrases that
protect them. We cannot recover an encrypted backup if its key or passphrase is
lost.

6. Updates

We may provide updates at our discretion. Updates are covered by this Agreement
unless they come with different terms.

7. Termination

This Agreement remains in effect until it is terminated. It terminates
automatically if you breach it. When it terminates you must stop using the
Software and delete all copies of it. Sections 2, 3, 5, 8, 9 and 10 survive
termination.

8. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY
KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN PARTICULAR, WE DO NOT
WARRANT THAT THE SOFTWARE WILL FIND EVERY SENSITIVE FILE OR EVERY EXPOSURE,
THAT IT IS FREE OF ERRORS, OR THAT BACKUPS IT CREATES WILL BE COMPLETE OR
RESTORABLE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER WE NOR OUR LICENSORS
WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR BUSINESS, OR FOR ANY
SECURITY INCIDENT, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT,
HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO
THE SOFTWARE OR THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE
SOFTWARE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY.

Nothing in this Agreement excludes or limits liability that cannot be excluded
or limited under applicable law, such as liability for intent, gross negligence
or personal injury.

10. General

This Agreement is the entire agreement between you and us about the Software.
If you have a separate written agreement with us that covers the Software, that
agreement prevails where the two conflict. If any provision of this Agreement
is held unenforceable, the remaining provisions stay in effect. You may not
assign this Agreement without our written consent. If we do not enforce a
provision, that does not waive our right to enforce it later.
